The registration of documents was started in the erstwhile State of Jammu and Kashmir by Maharaja Pratap Singh in the year 1920 under the Jammu and Kashmir Registration Act, 1977 BK and the registration of documents was done by judiciary. The erstwhile State of Jammu and Kashmir was reorganized in terms of the Jammu and Kashmir Reorganization Act, 2019 leading to creation of two Union Territories viz: Jammu & Kashmir and Ladakh. The Registration Act, 1908 (Central Act) became applicable to the Union Territory of Jammu & Kashmir after repeal of the Jammu and Kashmir Registration Act, 1977 BK.
The Registration Department was created as an independent department vide Government Order No. 117-Rev(S) of 2019 dated: 21.10.2019 pursuant to the State Administrative Council Decision No. 246/22/2019 dated: 22.10.2019 to provide an orderly, speedy and transparent system of registration to the citizens as far as possible near their doorsteps, reduce the burden of judiciary and minimize litigations through computerized registration process. Initially, 77 Sub-Registrar offices and 20 Registrar offices were set up across the Union Territory of J&K. This was followed by notification of 12 additional Sub-Registrar Offices raising the number to 88. 372 Non-Gazetted posts have also been created for different offices in the Registration Department and rules notified for filling up of both Gazetted and Non-Gazetted posts.
The Registration Department under the guidance of the Revenue Department and in consultation with its stakeholders endeavours to make registration of land/property documents simple and provide speedy registration services to citizens in a transparent, accessible and reliable manner through streamlined processes without compromising on the validity and veracity of the data.
The Registration Department would strive to accomplish its vision through the following steps/measures:-
Registration is the process of recording contents of a document with a Registering Officer appointed by the Government. The object of registration is conservation of evidence, assurance of title, publicity of documents and safeguard of land transactions against any fraud. All transactions with reference to any particular property are recorded in a register maintained at the Registrar/Sub-Registrar office (Mudkhal).
Under Section 23 of the Registration Act, 1908, any document other than a will has to be presented for registration within four months from the date of its execution. (i.e, signing of the agreement).
If a document is not presented for registration within the prescribed time period of four months, then the parties can apply for registration in terms of Section 25 of the Act, after paying the prescribed fine, provided delay in presentation is unavoidable.
The Registration Department is administered by the Revenue Department. The Revenue department is headed by the Administrative Secretary, Revenue of the rank of Commissioner/ Secretary to Government who reports to the Hon’ble Advisor(B) to Lieutenant Governor.
At the UT level, the Registration Department is headed by Inspector General of Registration, and assisted by two Additional Inspector General’s of Registration at Divisional level, 20 Registrars in 20 districts and 88 Sub-Registrars with supporting staff. The department has initiated earnest step to establish it as a full-fledged organization. The details of the offices are as under:

The basic platform for registration of documents is the National Generic Document Registration System (NGDRS) developed by Software Development Unit (SDU), Pune under Government of India, Ministry of Rural Development under “One Nation, One Software Programme”. The system was adopted in 5 Districts viz Jammu, Samba, , Udhampur and Srinagar w.e.f 18th September, 2020 (First Phase) and w.e.f 9th November, 2020 in the entire UT of J&K. E-stamping for collection of stamp duty through Stock Holding Corporation of India Limited (SHCIL) has also been launched in the UT w.e.f 18th September,2020. E-registration for collection of registration fee has been rolled out w.e.f 20th January,2021.
